§1 GENERAL PROVISIONS
The online store dajanadancer.com (hereinafter: Store) operates under the terms defined in this regulation.
The regulation specifies the conditions for concluding and terminating sales contracts for Products, the procedure for handling complaints, as well as the types and scope of services provided electronically by the Store, the terms of providing these services, and the conditions for concluding and terminating contracts for the provision of electronic services.
Every User, upon taking actions aimed at using the electronic services of the Store, is obliged to comply with the provisions of this regulation.
In matters not regulated by this regulation, the provisions of Polish law apply:
- The Act on the provision of electronic services of July 18, 2022;
- The Consumer Rights Act of May 30, 2014;
- The Act on out-of-court resolution of consumer disputes of September 23, 2016;
- The Civil Code of April 23, 2024, and other applicable Polish law provisions.
§2 DEFINITIONS
Personal data administrator – a natural person, legal person, public authority, unit, other entity, or person deciding on the purposes and means of processing personal data.
Order form – a form available on the Store’s website allowing to place an order.
Client – a service recipient who intends to conclude or has concluded a sales agreement with the Seller.
Consumer – a natural person who performs a legal act with an entrepreneur not directly related to their business or professional activity.
Entrepreneur – a natural person, legal person, or organizational unit without legal personality, that is granted legal capacity by law, conducting business or gainful activity on their own behalf.
Product – a movable thing available on the Store’s website which is the subject of the sales agreement between the client and the seller.
Regulation – this store regulation.
Store – the online store of the service provider operating at Rzepichy 10, Białe Błota.
Seller/Service Provider – Dajana Dancer Dajana Jurczak.
Sales agreement – a sales agreement of the product concluded between the client and the seller via the Store.
Order – a declaration of will of the client constituting an offer to conclude a sales agreement.
Price – the value expressed in monetary units that the client is obliged to pay to the seller for the product.
§3 INFORMATION ABOUT PRODUCTS AND HOW TO ORDER
The Store sells products via the Internet.
Products offered in the Store are new, compliant with the contract, and introduced to the market in accordance with applicable regulations.
Information on the Store’s website does not constitute an offer within the meaning of the law. The Client, by placing an order, makes an offer to purchase a specific product according to the terms given in its description.
The product price displayed on the Store’s website is given in Polish zlotys (PLN) and Euros (EUR), including all components but excluding delivery costs.
Orders can be placed through the website using the order form.
By placing an order, the Client must read and accept the Regulation.
§4 CONCLUDING THE SALES AGREEMENT
To conclude a sales agreement, it is necessary to place an order in accordance with §3 points 5 and 6 of the Regulation.
Upon ordering, the Seller immediately confirms receipt.
Confirmation of order receipt binds the Client to their order and is sent via email.
The order confirmation contains:
- confirmation of all essential order elements;
- withdrawal form;
- this regulation including withdrawal rights information.
Upon receiving the confirmation email, a sales agreement is concluded between Client and Seller.
Each agreement is confirmed by a proof of purchase attached or sent electronically.
§5 PAYMENT METHODS
The Seller provides the following payment methods:
a) payment via electronic payment system.
Payment is made before order execution and may be done by credit card, quick transfer from selected Polish banks, BLIK, IDEAL.
The Client must pay within 2 business days unless otherwise stated.
The product will be delivered after payment.
§6 COST, TIME, AND DELIVERY METHODS
Costs of delivery are borne by the Client.
Delivery time includes order processing and carrier delivery.
Purchased products may be delivered electronically
§7 COMPLAINTS
The Seller’s liability to Consumer clients for non-conformity with the contract is based on the Consumer Rights Act.
For entrepreneurs, liability is based on the Civil Code.
The Seller is liable for non-conformity existing at delivery and disclosed within 2 years.
Complaints can be sent by email to info@dajanadancer.com.
The complaint should include details about the issue to facilitate processing.
The Consumer is obliged to provide the product for inspection, which the Seller must collect at their cost.
The Seller must respond within 14 days.
Failure to respond is deemed acceptance.
Replies are sent via durable medium such as email.
§8 RIGHT OF WITHDRAWAL
Consumers can withdraw within 14 days without giving reasons.
Upon withdrawal, the sales agreement is considered not concluded.
The Consumer must return the product within 14 days unless collection is offered. Returns are sent to info@dajanadancer.com.
Consumers bear costs of reducing product value beyond necessary inspection.
Refunds are made by the original payment method unless agreed otherwise within 14 days.
Additional delivery costs by the Consumer are not refunded.
Refunds may be withheld until product return or proof of dispatch
§9 TYPE AND SCOPE OF ELECTRONIC SERVICES
The service provider enables sales agreements electronically.
Provision is governed by this Regulation.
The provider may include advertising content on the site.
§10 TERMS OF ELECTRONIC SERVICES
Electronic service provision is free.
Contract duration is until order placement or cessation.
Technical requirements for users: device with internet, email access, web browser, cookies, and JavaScript enabled.
Users must comply with law and good practice, providing truthful data and refraining from illegal
content.
§11 COMPLAINTS ABOUT ELECTRONIC SERVICES
Complaints on electronic services are sent via email to info@dajanadancer.com.
The complaint should include detailed information to facilitate resolution.
Responses are sent within 14 days to the provided email or other contact method.
§12 FINAL PROVISIONS
Contracts through the Store are governed by Polish law.
In case of conflict with the law, legal provisions prevail.
Disputes between the Store and Consumers are primarily resolved by negotiation, then by court, following the Act on out-of-court consumer dispute resolution.
Disputes involving the Service Provider and Consumer Clients are subject to competent courts according to the Civil Procedure Code.
Consumers can also use out-of-court dispute resolution mechanisms including mediation or arbitration; info and links provided.
Consumers can also seek free help from consumer ombudsmen or organizations. The consumer may use the online resolution platform ODR at http://ec.europa.eu/consumers/odr/.
